New Guide and Toolkit on How to Use the EU Victims' Directive

PICUM has published a Guide to the EU Victims' Directive together with a toolkit in English, French and Spanish with resources for members and partners, to inform and to inspire action to advance the rights of undocumented victims of crime.

The EU Victims' Directive (Directive 2012/29/EU establishing minimum standards on the rights, support and protection of victims of crime) guarantees dignity and respect, as well as access to minimum services, protection and support, for all victims of crime, irrespective of their residence status. All member states (except Denmark, which has opted out of the Directive) have until Monday, 16 November 2015, to implement the guarantees of the Directive into their national laws.

PICUM's new Guide first and foremost aims to provide those organisations working on the front-lines with undocumented migrants with the tools and the information to advance their rights in the framework of the Directive. The Guide is also intended to inform policymakers, law enforcement and other official actors of how the Victims’ Directive relates to undocumented migrants as a specific category of victims, and the particular challenges they confront based on their status and circumstances in getting the protection and support they have a right to. Its seven recommendations break down the elements needed for member states to make good on the guarantees in the Directive.

PICUM will also publish a statement in English, French and Spanish on 16 November, the actual day of the transposition deadline, calling on member states to meet their obligations to guarantee the rights of all victims of crime, by prioritising their safety and dignity over their immigration status.
